My understanding of article 52.2 is that the source code or the binary
code as such can not be considered as invention.

The recent IBM case, from what I know, resulted in admitting that a
"software product" (ie. the material software pacakge with floppy, CD,
etc.) can be considered as an invention.

Therefore, a program as such may not infringe on anything. Only the use
of the program in a computer may lead to an infringement.

How can this be wrong ?

JPS.
