Subject: [Patents] Just another one thing...

Hi there,
I think that our, antipatent ideas are as clear as to be
given to lawmakers.

  - there is no "right to patent" - patent is a privilage
given by the state;
  - patent is given NOT for inventor's own sake, but for the
sake of the industry; and if patent system fails to help
industry, or, better - it can not help, and may make mess,
and eventually harm the industry, the patent shall not be given

  - patent system was established to protect money -- to save
it for production, not for competition; it could really happen
in "material" industry, such as steel industry or even electronic
industry; As software patent cases, searches, claims etc. are so
expensive, where are the money the patent protects ? Don't you see
a trap here ?

  - the "international treaties", though they sound very heavily and
seriously, aren't "unbreakable"; for example, USA wanted to make
European Union to lift the ban on US Hormone-Fed Beef; both USA and EU
has been subscribing WTO (World Trade Organization) treaties and
agreements, and it has failed, fortunately; and, when in 1999 France
(and maybe Germany, I'm not sure) has broken from the Wassenaar treaty,
and allowed to make and distribute ANY encryption methods, there was
no problem; and even under intl law, the side "may break the treaty
to protect its interest". It IS an interest of EU now to abolish the
software patents, and let European market survive; and nobody as
I think wages war against Europe ;-)))

So I don't know what is the problem, and for what are so hot
discussions we make; I think we should contact as much media as
it is possible to make the problem -- the patent disease --
easily readable by anyone. And I don't know what can we get arguing,
discussing, etc, about the patents. Maybe let's think together about
a campaign ? The worst thing is, that there are few or no opposers
to patents in Europe, and there are many advocates of American
position in the case; it seems that Europeans want to give up to
foreign power... It's sad.

I make my conclusions after reading "Industry at Risk".

  antipatently yours

PS. Anyway, someone may move to any "banana republic" that hasn't
signed any treaties with USA about patents, and make there any
software...
