Subject: [Patents] Third Paradigm between Patent and Copyright

The scheme for a pre-publication competition might not always work well
the way I conceived it. Here's a simpler, more robust solution:

...

One month before the logilege publication, the "problem to be solved
by the innovation" is published, and the logilege description is
escrowed. From this day on up to the publication of the logilege
description, any person may publish solutions to the problem, which
become prior art. If such prior art invalidates the logilege, the
deposit sum is paid to the author of the earliest invalidating
   publication.

...

Many aspects of the logilege could also serve to inspire a reform of
the existing patent system. But within the framework of treaties such
as TRIPS, such a reform is hardly feasible, and in the area of
concrete-physical inventions, the necessity for it is not felt very
clearly. For example, the invalidating competions are indispensable
for abstract-logical innovations, because the privilege-worthy
innovations must be filtered out from a volatile world where
innovation is daily routine and the state of the art is rarely
consulted let alone documented. Thus any third paradigm system of
exclusion rights faces specific challenges, for which the patent
system never needed to develop an answer.
