I thought we'd been over this fallacy of yours: the fact that
there exists a correspondence between H and S does *not* establish
identity of H and S. Do you want me to spell it out in predicate logic?

The fact that H and S satisfy a bunch of predicates is no guarantee
that they satisfy any other predicate. Classical fallacy. Elementary really.

It is perfectly acceptable to mathematical logic to distinguish
between hard and software on the basis of whatever predicate
you choose. We're discussing choosing the predicates on which
to distinguish between them here, so we can validly exclude software
patents, which many of us find so harmful they warrant special treatment.

Your hints at mathematical logic backing your statements
are misleading to say the least.

But of course it's always refreshing when people are going to
use math to substantiate their political opinions,
because at least we can separately discuss truth and validity.
