Replies to the Consultation Paper on the Patentability of Computer-
Implemented Inventions =20

On 19 October 2000, the European Commission launched consultations=20
via the Internet on the patentability of computer-implemented=20
inventions. Interested parties, the public at large and Member States=20
were invited to comment by 15 December 2000 on the basis of a=20
consultation paper. The aim of the consultation is to help the=20
Commission to identify the best approach to the issue so as to strike=20
the right balance between promoting innovation and ensuring adequate=20
competition in the market place. At the top of that webpage, those=20
commenting on the Commission's consultation paper were asked to=20
indicate whether or not they agreed to their comments being published=20
by the Commission, either "as is", or without their name, address=20
etc. Answers from authors who have agreed to publication are being=20
reproduced below. =20

In the context of the Commission's consultation, a great number of=20
comments were sent to consultation@eurolinux.org and published at=20
http://petition.eurolinux.org/consultation. Copies of such comments=20
have been received by DG Internal Market. This webpage was set up by=20
the EuroLinux Alliance of software publishers and non-profit=20
organisations. The EuroLinux Alliance indicates on that webpage that=20
it has created a public forum and asks European consumers, European=20
IT professionals and European companies to send public statements,=20
reports and position papers on software patents to=20
consultation@eurolinux.org. The EuroLinux Alliance further states=20
that e-mails sent to that address are automatically being published=20
on their above webpage and forwarded to DG Internal Market. In line=20
with the notice at the top of the Commission's webpage mentioned in=20
the first paragraph, comments sent to consultation@eurolinux.org and=20
forwarded to the Commission are published below only where their=20
authors have expressly agreed to such publication by the Commission. =20

Furthermore, the United Kingdom Patent Office carried out a=20
consultation on the question as to whether or not patents should be=20
granted for computer software or ways of doing business. For further=20
information, please visit the website of the UK Patent Office. =20
