Subject: [Patents] Stopping the 'patent war' between companies -- solution -- non-aggression agreement (noaa)
Message-ID: <20010612233441.3BCCD10D47@stabilite.aful.org>

Hello y'all.
I've came to one idea, that may be good.

I know, that a lot of companies (especially, the 'small business'
ones) file and obtain sw patents "for the defensive means only" -- to
not be "outpatented" by their competition. It may be called "a
prisoner's dilemma" -- not filing a patent would be the best choice
for everyone, yet nobody does it. In effect, companies lose the
loads of money on senseless "patent wars", "patent dules" and so
on -- on trials, claims' searches, and so on.

Thus, I came up with some idea that might see 'typical Polish' :) in
some way: Solidarity. You know, how has communism fallen in
Poland ? People stopped to fear each other. They started to help
each other. They started to *unite* in some way; "homo homini
lupus est" lost its meaning in those great times in Poland.
The people "signed" (rather vocally, or even -- spiritually) a form of
treaty: you will not denounce me to the secret police, I'll not
denounce you. You will help me, I will help you. 'twas a great idea;
commie ruling bastards couldn't do anything against it. Even the
'martial law' hasn't changed that evolution -- towards the free
society -- a lot.

But why I'm writin about it ... You know, the companies, which are
anti-patent by default, could write & sign a kind of *treaty* -- Patent
Non-Aggression Treaty (PNoAT). It would state something like that:

"We, undersigned below, hereby solemnly swear and declare, that
we will never issue any patent claim or lawsuit against each other.

   Signed on behalf: (examples)
       Acme corp., John Smith, CEO
       X GmBH, Hans Hertlich, CEO
       Y corp., Mike Bull, CEO

It would be the 'eternal peace treaty'. I'm almost sure, that, once
acknowledged with it, a lot of companies would "lay down their
swords, down by the riverside" and "ain't study the patent war no
more". After all, it's better to do normal business than to
senslessly attack each other. The first ones to sign such
multilateral agreements might be the small companies, but some
"big" companies surely would join later. Agreements should be
open and public -- eg. published on some websites. Anyway, as
someone said "big companies are just the small companies that
became bigger".

What do you think ? Anyway, I'm going to publish this idea, and
get some companies interested with it.

     Yours in Liberty,
          Critto
