Dear Sirs,
I might come with a humble opinion regarding software patent. Reading at
this (french) document, once ought to ask ourselves whether the European
action against software will lead us in a dead end.
http://uspatentinfo.com/busmethod-FR.html
I feel there is a lot of effort too, for preventing the use of business
methode world wide and especially over internet.
In Europe we know the rule, which permits to use a patented device embarked
on a vehicle without to be worry about infringement while driving in a
foreign country.
Will the same rule be applied in the field of software and business method
patent, especially on internet?
There might be two cases to consider:
a- use of a business methode, which might be inadvertently used
or view through an US person.
b- objective use of a patented business methode over internet
from a foreign country.
Borth cases fall within infringement, because of export of patented good.
What's happen here seems to me to be a big thread about doing business world
wide.
When the US want to forces us to introduce software patent, I hope that the
European will be clever enough to trade it at least with the Kyoto agreement
about environment.
What does the oponents say regarding patenting software and business method
in regard of the above said?
sincerely
Jean-Jacques Wagner
