Hello y'all.
I've been just thinking about history, and WHAT has made it.
After my considerations, I came to conclusion, that those were not
the laws; the laws have been repealed, broken or neglected as it
happens all the time; the bad and good laws altogether, to add.
The software-patent supporters claim, that we must introduce sw
pats in Europe, because WTO and WIPO demand it, in their
regulations.
Then I came to conclusion: WHAT, if Europe renounced all, or only
parts, of WTO's and WIPO's treaties? What could such action be
named like?
Certainly, it would be NOT the law as such; even if Europe was
going just to neglect the TRIPS, she's free to do so. Just to break
this treaty, et voila. What could happen then?
Could US, or any other 'power' wage a war on Europe, with rockets,
tanks, warships, jet fighters and even nukes? It's unlikely. US is
not a mad, bloody EMPIRE, and even some empires (as USSR
when it existed) didn't think to attack Europe for real.
So, the threat of military action may be thrown to the dustbin (of
history). What next?
Sure, US could impose some sanctions on Europe. But, what
could happen then? We produce the food, we produce cars, we
produce steel and other industrial products, we produce hi-tech and
NOTHING could change. After all, EU DOESN'T accept some
American products, as beef and bananas; US yell, whine and cry
about it, but nobody cares. We have our own bananas; beef is not
very popular because of BSE, so we changed our flavors to chicken
meat, beacon and other kinds.
WE, EUROPEANS are the superpower; meanwhile, our 'leaders'
act like the servants of USA and of the organizations like WTO or
WIPO; they are no leaders at all, but a handful of stupid guys.
Well, the drive to patent everything is -- as we all know it here --
VERY DANGEROUS. In many ways, it's similiar to the drive to
relegalise slavery in XVII/XVIIIth century, after the ages of its
nonexistence (peasantry was similiar, but not equal to slavery).
Simply, it started to PAY the plantation owners in Americas to buy
slaves, so it became payable to pirates and corsairs to catch the
slaves in Africa (and in other continents, too; there were even the
slaves from Europe, and a lot of Asia). NO laws, NO Christian
values meant anything: MONEY was the most important factor.
Now, what I call to, is NOT the negation of capitalism or of
globalisation. But the capitalism must be based on free-market; the
non-market 'capitalism' is being called 'fascism' by the pro-market
libertarians (there's a good essay titled "Towards the libertarian
theory of fascism) -- it's the kind of socialism for the owning class
(by contrast to the 'proletariat's socialism')
Globalisation must mean TO GO GLOBAL WITH FREEDOM; with
free minds, free ideas, free actions, and free markets; with global
laissez-faire. The patents are something contrary to the laissez-
faire ideas: they constitute the governmental assault on the free
flow of goods and ideas, to benefit some groups at the expense of
others; their existence mean that there is "win-lose" strategy,
instead of the "win-win" one, existing in the Free Market conditions
only.
We NEED the reasonable opposition to WTO and WIPO; and to
IMF and WB as well. The rioting young hooligans, who break
windows' glass, set arsons and beat up policemen is NOT the
opposition to the enslavement those organisations bring us; all
they oppose to is the REMAINING FREEDOM, the rests we still
have. They're as dangerous as the global cartel of governments and
corporations, which together are called 'World Trade Organisation',
'World Intellectual Property Organisation', 'International Monetary
Fund' or 'WB'.
One may claim, that the "anti-globalisation" hools are just the
hools and no opposition at all -- but they are too well organised to
be the hools ONLY.
And so, while libertarians agree with leftists on the issue of
ABOLITION of those organisation, they differ on the reasons of this
way. While leftists are against freedom, we, libertarians, promote
freedom and we read the global tyrants as the biggest threat to it.
If the sw-patents is not enough to be called 'tyranny', look at the
DMCA -- it's compatible with the WIPO's world policy. Now, there's
SSSCA (SS came from the nazi-SS as I think, so
SchutzSchtafetten Shit is Coming Act ;) would be a good shortcut
for it), which, if passed, would PROHIBIT writing any programs
which don't contain the copy-protection measures, not just the
ones who allow to break them. And, if it's passed in USA (which
seems unlikely), we may see WIPO pushing it in Europe.
Fortunately, not all of our governments are stupid. Some of them
use Linux and prefer it to Windows or other crap (sorry, Microsoft),
and this gives us some hope that the stupidity of sw-pats will never
be fully accepted in Europe.
We should form a global coaliton opposing to tyranny; we need
supporters in USA, too -- there's a lot of programmers and small
companies who are threatened by the sw pats. Anyway, haven't
the current economic troubles in IT branch been caused by sw-
patents and DMCA? Aren't the German programmers coming back
to Germany from US because of Dimitry Sklyarov's case? I think
this claim may be right ...
And now, there is the turn for Europe: to RENOUNCE any sw-
patent strategies, to abolish (or nationalise) all of them, and even to
renounce parts of, or the whole, of WTO and WIPO treaties. We
need FREE Europe; we have been too long enslaved by the
totalitarian regimes; now, the new regime is coming, and we must
defy it as well.
Brasil has defied (simply, broken) the AIDS-cure patent; Brasil is a
local superpower, too, but it is far poorer than European countries
altogether or even some of them alone (Germany, France). We
should simulate her in this case -- this is the case for OUR,
(PAN)EUROPEAN INDEPENDENCE.
And then, we see that we, in Europe, can make HISTORY again;
by facts, NOT BY THE STUPID AND HARMFUL LAWS, which
should be repealed, and while they are not, every free man and
woman, and a company and a government should neglect and
break them.
PS. This essay will be available on my pages -- I'm working on it.
