It seems that a community design directive drafted by DG Internal Market
has been adopted by the member states:
http://europa.eu.int/rapid/start/cgi/guesten.ksh?p_action.gettxt=gt
&doc=IP/01/1803|0|RAPID&lg=EN&
This allows a europe-wide registration of designs which will then not be
usable by anyone else, even if found independently. It looks as if this
could also be applicable to web design.
So far, nothing of this sort has been regulated on a very wide
international basis. Therefore we don't know yet to what extent it could
become a problem.
