Hello,
it's Critto here.
I've got one question:
Can the patent owner regulate the aspects such as sale, distribution and use
of a thing, that has some patented parts, and thus, limiting the free trade?
For example, if somebody wants to sell a car (or become a car dealer), which
owns some patented parts (eg. ABS system, etc.), or to open a shop selling
computer parts (which are commonly patented), may a patent owner limit the
right to sale and re-sale? Or, to regulate the usage of a car: for example,
to charge the taxi-owners, for-pay courriers, and so on?
AFAIK, patent owners control the production and use of the patented
technologies in the production only, and limiting the sale or use is
impossible, but I'm not sure and thus I'm asking this question. Can anybody
help me?
My question was inspired by the example with seed: how could a seed producer
constrain somebody from selling the seed that this person/entity bought from
this producer, paying for it and all the rights?
I'd be grateful for any questions.
Yours,
Krzysztof (Christopher) "Critto" Sobolewski
