I'm sorry for my english and for not being a lawyer, but as a sw developer I
like to share my opinion with you.
CAN I CAPITALIZE MY JOB, OTHER THAN MY MONEY?
If I capitalize my job, that is, if I store my own written components and
make them reusable to me, I'm spending 99% of my effort in recoding obvious
algorithms, while I'm giving myself a chance to catch a market. As big as it
is possible to me. Given that I can't pay too much but I can work a lot.
CAN I WRITE AND SELL A PROGRAM?
This is a key notion in an economic system that aims at being pluralist and
liberal: I play the game honestly with the tools that my condition lets me to
access and use. What can I access? For sure I can't assemble an airplane but
I can write an XML based software solution. Why? It's easy: they are selling
me programmable (and not 'airplainable') machines, at a price that I can
afford. And I like to try selling my sw solution, I feel free to act this
way.
CAN I COMPLY WITH THE LAW?
At this point I put the problem in terms of knowledge: how can I know about
every single possible patent infringement? Is there anybody capable to study
my software and ensure me that it is infringement-free? And at what cost?
I believe that: 1) almost every single existing program can be traced back to
some existing patent claim and; 2) usually the author doesn't know about this
and 'reinvents' it (sw patents are obvious).
MY CONCLUSION
Thus, somebody is suggesting me a system where I can write a program but
I can't comply with the law. A law that is not possible to comply with,
leads to discretionary application.
This is against the principles of liberalism.
Regards.
