The patent office praxis regarding applications on computer related
inventions has during the last years looked for its form.

There has been changes in the praxis at the EPO, and after certain
decisions of the Boards of Appeal of EPO, EPO has adopted an
interpretation that among other things accepts so called program
claims [programvarukrav] (EPO Guidelines, october 2001).

The European Union has simultaniously put up a goal to simplify and
harmonize the regulations on computer related inventions in member
countries. In this regard the Commission arranged in autumn 2000 an
extensive hearing and issued a directive proposal in 20.2.2002.

> det direktivförslag som var under arbete.

The directive corresponds largly to the praxis that EPO has adopted, but
differs from it regarding the program claims [programvarukrav] that EPO
and also some other member states already had adopted. In Finland these
claims were however not accepted, but one waited for the directive
proposal that was under work.

> praxis som kunde bli kortvariga, och beslöt i stället att vänta på
> det slutliga direktivet.

Since the directive proposal still/anyways corresponded the praxis at
FiPTO, the FiPTO did not find it appropriate to start to use new
praxises that could be short lived, and decided instead to wait for the
final directive.

The Council handled the proposal repeated times autumn 2002, and member
countries came to a broad consensus at the competition council meeting
14.11.2002 on the content of the proposal, where among other things
program claims were accepted under certain conditions.

Finland too supported this compromize and the same positive stance to
program claims was adopted both in state council [statsrådets] paper to
the parliament [riksdagen] 5.9.2002, the economical committie
of the parliament 1.10.2002 and the parliament large comittie procedures
5.11.2002. [(all these are finnish bodies)]

Parallelly with the Council the Parliament has also processed the
directive proposal. ITRE and CULT has drafted amendements that
are negative to program claims.

The general spirit of the drafts is to make higher patentability level
of computer related inventions and by that rather limit patentation
within this techniacl field than make sure that the different technical
fields are equalized when it comes to conditions for patentability.

The opinions of the comitties and among others JURI are not final, and
one does not know how Plenum will stand on the issue. The Council and
the Parliament seems to have walked in different directions on the
view of the comission proposal. Mediation will thus be needed between
the Council and the Parliament, and it can take time.

The FiPTO has waited almost a year for the directive proposal to be
handled. FiPTO has recieved a large amount of patent applicatins that
among other things contains program claims. The further processing
of these applications are risking to be delayed if the FiPTO does
not make a decision on the praxis.

FiPTO has thus waited for the final directive to avoid changes in FiPTO
praxis that perhaps will be temporary. Since the views within the EU in
this matter are so divergent the point of time of a compromise and
thereby a final directive is undecided.

It is however already possible in Finland to enforce/apply [bringa i
kraft] an application that contains program claims, by applying for a
patent directly at the EPO. Appliers will be in an unequal position
if the FiPTO does not change its praxis. There are no obstacles or
inconviniences for FiPTO to change its praxis in a way that it
corresponds to current EPO interpretation, neither from regulations or
examination point of view.

Regarding patentation of computer related inventions, the FiPTO will
change its praxis in a way that it will follow the same praxis as
the EPO, until the final EU directive on computer realted inventions
is decreed.

This means that among other things program claims will be accepted in
accordance with EPO praxis.
