I am sure this as been discussed before.
It is not Software Patent minded but maybe it is related to it.

And my guess is that you already know (it is old news).

I believe this idea of insurance is wrong and was created to reduce 
critics against the "SME don't like patent and patent cost too much to 
defend." argument.

It is not clear if such an insurance is for protecting your patent 
(defense) or protecting from the patent of other (attack). ;-)

Also having such insurance is a way to garantee business for the law 
peaple. Since you don't have to pay big money but many pay less money 
and the insurance pay the big money they want.

And then if talking about Free Software and small one/few-man Free 
Software project... Having them paying such an insurance is already too 
much money to ask for what could be their free time stuff.
