Computer Based Testing Patents

Hi,

I found a pdf document through google
(europa.eu.int/comm/internal_market/ en/indprop/comp/appendix44.pdf)
that talks about various software patents being illegal.  It mentions 
one about computer based testing that potentially affects me.  I am 
involved in the production of some software that we beleives voilates 
that patent, and have to resolve any patent questions before we can 
receive funding. 
Can anyone clarify the current situation in Europe about software 
patents, for example does anyone know of an instance where the holder of 
a software patent has instigated litigation against infringers, and if 
so, what the outcome was...
