Hi
Although this might be a bit of a digression, has anyone seen a good critical
commentary on the enforcement directive proposal (Com (2003) 46 Final)?
http://europa.eu.int/eur-lex/en/com/pdf/2003/com2003_0046en01.pdf

I originally ignored it as it seems to apply only to copyright and trademark
issues, but I noticed that the most recent proposal it covers also
infringement of a European patent issued under the EPC, and technical
protection measures. The rules seems to be highly draconian and accepts all
the problematic evidence collecting legal measures, provisional measure etcs.
without giving the potential infringer (and his "links"- those who are named
by the infringer, including service providers) a possibility to be heard.
