Somebody sent an answer by a pro-swpat Liberal MEP that didn't
understand much that in mobile phones and other gadgetry there
may be innovatiosn worth of patents (antennas?) and some
not (IP stack, compression).
I thought I might send the views of another Liberal MEP from tuesday.
(the link in the swpat.ffii.org page does not lead to the declaration,
but to the MEP web page in the Europarl).
important rebuig entre desenvolupadors[2], petites i mitjanes empreses[3] i
usuaris de programari lliure[4] (i aixo inclou cada cop més
prototipus i experiments.

Translation: Gasoliba adhered to:
Vote for the software patents directive
Today the European Parliament committee on Legal Affairs and the
nternal Market (JURI) votes the directive com(2002)92, which
arose an important rejection among developers[2], small and medium
enterprises[3] and free software users[4] (this includes increasingly
more public administrations in the EU[5]).
In case of passing the directive as the Commission or the JURI rapporteur
presented it, software free market will be threatened by offical monopolies
lasting up to 20 years on abstract programming concepts, business methods,
formats or communication protocols.
Patents for material apparatus and processes represent an incentive for
research and development of new technical solutions which otherwise
would not be profitable to invent but would be profitabel to produce
from someone else's research, without spending on laboratories,
prototypes and experiments. Intellectual activities such as programming
do not need this expense in empirical research. Instead, the expensive
part is composing many rules and procedures in a coherent solution,
effort which is already covered by copyright.
This is way these two kinds of innovations must be separated, so that
patents are granted only for new uses of controllable forces of nature,
and not for data processing. Other amendments that should pass would
be those ensuring interoperability, and that use and distribution of software
is covered by copyright, not by patents.
This would be a good way to mantain and improve innovation in software
so that European enterprises and consumers can enjoy more competitive
software and computer services. Since they have software patents in the USA
and we don't have them in Europe, it has been oberved a drecrease in
research and development intensity in the USa between 10 and 15 % [6],
and the OCDE has done more research than USA this last 5 years [7]
