  This might be because courts are totally ignorant of the matter?

  Example of how easy it is to separate idea from expression:


    IDEA                 EXPRESSIONS

    an user's desktop    Windows, MacOS, GNOME, KDE, XFCE, ...
    a www browser        Internet Explorer, Mozilla, Konqueror, Opera...
    a word processor     Microsoft Office, OOWrite, AbiWord, KWord...
    math for 2           3-1=2   1+1=2

Another Idea:
    guy meets girl, they fall in love, they breakup, they get together
again

With a never ending number of expressions coming from Hollywood, the so
called romantic comedies...

What you say may make sense if you don't understand software.

But in reality, it makes no sense.
