As I recall, most of the national legislatures of Europe have approved the
TRIPS treaty. TRIPS has a clause that if something is patentable as a
technology in any TRIPS member state, then all other TRIPS member states
have to provide such patent protection. This is now the law of the land
of most European countries, done with the approval of their legislatures.
In TRIPS member country - the United States - software and business methods
are fully technical (an assertion fully supported by tons of computer
science and economics research in Europe). Therefore under TRIPS,
European countries are acting illegally in denying such patent protection.
At some point, this TRIPS defense will be raised in the European courts.
Don't you think you should lead a fight to call for the repeal of this
clause of TRIPS?
